By accessing and using Moosen ("the Service"), operated by Diving Moose Studios, LLC ("we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement, including our Content Guidelines. If you do not agree to these Terms & Conditions or our Content Guidelines, please do not use the Service.

Your use of the Service constitutes your agreement to comply with all applicable policies, including but not limited to our Content Guidelines, which are incorporated by reference into these Terms & Conditions. Violations of our Content Guidelines may result in account suspension or termination as outlined in those guidelines.

Moosen provides automated social media content generation and scheduling services. The Service allows users to:

  • Generate social media content using artificial intelligence
  • Schedule and publish posts across multiple social media platforms
  • Manage multiple social media accounts from a single dashboard
  • Analyze content performance and engagement metrics

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Generate or distribute spam, malware, or harmful content
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any portion of the Service
  • Generate content that is illegal, harmful, threatening, abusive, or offensive

Content Guidelines: You must comply with our Content Guidelines, which set forth specific rules regarding prohibited content, spam behavior, platform terms violations, and acceptable use of the Service. The Content Guidelines are an integral part of these Terms & Conditions, and violations may result in immediate account suspension or termination as detailed in those guidelines.

5. Content Ownership and Rights

Your Content: You retain all rights to the content you create using the Service. By using the Service, you grant us a limited license to use, store, and display your content solely for the purpose of providing the Service.

AI-Generated Content: Content generated by our AI is provided to you for your use. You are responsible for reviewing and ensuring that all AI-generated content meets your needs and complies with applicable laws and platform policies.

6. Third-Party Integrations

The Service integrates with third-party social media platforms. Your use of these integrations is subject to the respective platform's terms of service. We are not responsible for:

  • Changes to third-party platform APIs or policies
  • Service interruptions caused by third-party platforms
  • Content moderation or removal by third-party platforms
  • Account suspensions or bans on third-party platforms

7. Subscription and Payments

Subscription Plans: We offer various subscription plans with different features and pricing. Details of each plan are available on our pricing page.

Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually). You authorize us to charge your payment method for all fees incurred.

Cancellation: You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds are provided for partial billing periods.

Price Changes: We reserve the right to modify our pricing. We will provide reasonable notice of any price changes and offer you the opportunity to cancel if you don't agree.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Diving Moose Studios, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Disclaimers and Limitations of Liability

Service Availability: The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

AI Content: AI-generated content is provided as a tool to assist you. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content. You are responsible for reviewing and editing all content before publication.

Limitation of Liability: To the maximum extent permitted by law, Diving Moose Studios, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless Diving Moose Studios, LLC from any claims, damages, losses, liabilities, and expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe:

  • Violates these Terms & Conditions or our Content Guidelines
  • Is harmful to other users or the Service
  • Exposes us to legal liability
  • Is otherwise inappropriate

Violations of our Content Guidelines may result in warnings, temporary suspension, or permanent termination as outlined in those guidelines. We may take immediate action for severe violations without prior warning.

12. Changes to Terms

We reserve the right to modify these Terms & Conditions at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Diving Moose Studios, LLC operates, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration in accordance with the rules of the applicable arbitration association.
